Dr. Gavin Ye practices all aspects of patent law. His decade-long experience includes patent asset creation and transaction, portfolio management, client counseling, patent litigation before federal district courts and Section 337 investigations before the U.S. International Trade Commission (ITC), and post-grant proceedings before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO). He leverages his extensive experience in patent prosecution and patent litigation to strategically protect client’s intellectual properties and to defend the clients against patent infringement claims.
Gavin has drafted and prosecuted more than one thousand patent applications. He routinely interviews inventors to develop patent strategy, interviews examiners to advance prosecution, and appeals rejections to the PTAB. He is skilled in leveraging various procedural avenues to achieve specific prosecution objectives, ranging from fast allowance (for example, an application was allowed in less than four months after filing) to broad protection scope (for example, an application was allowed with an intact claim set after appeal).
Gavin’s extensive patent litigation experience includes pre-litigation investigations and due diligence, fact and expert discovery, motion practice, claim construction analysis and briefing, deposition of fact and expert witnesses, and summary judgement briefings. He is also experienced in leveraging PTAB proceedings to gain advantage in settlement negotiations.
Gavin also has deep understanding of cutting-edge technologies and thus able to communicate with innovators effectively, thanks to the rigorous training he received from academia, as well as his continuous learning of frontline scientific and industrial advancements. His broad experience includes artificial intelligence and machine learning and their applications in diagnostic and therapeutic medical devices, financial technology (FinTech), and autonomous driving; smart appliances utilizing complex control of electromagnetic energy; e-commerce platforms fusing clouding computing, advanced payment systems, and data-driven growth strategies; telecommunication technologies forming the bases for LTE and 5G standards; miniature chemical analyzers stemming from space projects; sharing economy systems disrupting traditional transportation and lodging industries; as well as such diverse fields as semiconductor devices, consumer electronics (game consoles, cameras, printers, etc.), mechanical systems, medical imaging devices, power electronics, circuitry, computer simulation software, network technologies, and business methods.
